网络餐饮阳光厨房的实践困境及发展路径探析

摘要:随着网络餐饮行业的快速发展,食品安全问题日益受到消费者的关注,网络餐饮阳光厨房应运而生,成为食品安全监管的新模式。网络餐饮阳光厨房依托互联网技术,通过实时监控将餐厅后厨操作过程展示在网络平台上,旨在提高食品制作的透明度,保障食品安全。然而,实践中阳光厨房模式的运行却面临着隐私权保护、商业秘密泄露、外卖平台责任风险以及阳光厨房实际覆盖率较低等诸多困境,一定程度上影响了阳光厨房效用的发挥。为应对以上挑战,该文通过提出完善相关法律法规,加强商业秘密保护,强化外卖平台自律机制,发挥政府在引导中的保障引导作用等一系列方案,为优化网络餐饮阳光厨房的持续发展路径提供建议,提高网络餐饮行业食品安全水平。

Practical Dilemmas and Development Path Exploration of the Sunshine Kitchen in Online Catering

Abstract: With the rapid development of the online catering industry, food safety issues have increasingly garnered consumer’s attention, leading to the emergence of “Sunshine Kitchen” in online catering as a new model for food safety supervision. “Sunshine Kitchen” relies on internet technology to display the operations of restaurant kitchens on online platforms through real-time monitoring, aiming to enhance transparency in food preparation and ensure food safety. However, in practice, this model faces several dilemmas, such as privacy rights protection, trade secrets leak, liability risks of food delivery platforms, and relatively low coverage of “Sunshine Kitchen”, all of which hinder its effectiveness to some extent. To tackle these challenges, this paper proposes a series of solutions, including improving relevant laws and regulations, strengthening trade secret protection, reinforcing self-regulation mechanisms for delivery platforms, and enhancing the government’s ensuring and guiding role. These measures aim to provide suggestions for optimizing the continued development path of “Sunshine Kitchen” in online catering, ultimately improving food safety standards in the industry.
